Terms and Conditions of Service
The photographer refers to ”Porter Photography” and “Abigail Porter”.
“Client” refers to the person who is wanting the service.
Terms of service
- A client below the age of 18 needs a parent to act on their behalf and also be present during the shoot. Parents must have also agreed to terms and conditions.
- If the photographer is late then the shoot will take place from that time and the booking time is still the same.
- Edited images take between 2-4 weeks, products can take 6-8 weeks to be completed and delivered. Please allow an extra 2 weeks in busier periods i.e. Christmas
- Abuse towards the photographer or photographer’s equipment will not be tolerated.
Payment and cancellation
- A non-refundable deposit will be taken at the time of booking. This will be £100 of the service that the client is wanting.
- If the client wishes to cancel it needs to be made clear 14 days before the photoshoot, late cancellations will receive a 50% refund. This cancellation refund will only occur if the full-service fee is paid.
- If the photographer needs to cancel this will be made clear and a further date will be rearranged i.e. weather, personal circumstances.
- The deposit needs to be paid when booking to secure a date, outstanding payments need to be paid by the agreed date of the shoot. If the client doesn’t pay the deposit photographer may make other arrangements.
- Any travel exceeding 20 miles from BL4 will be charged 50p per mile.
Liability
- A liability waiver needs to be signed, under 18’s need an adult signature.
- Directions and poses given by the photographer are undertaken at the client’s own risk. The client should be able to asses the situation and make a decision to ensure themselves and the horse is safe.
- The client needs to assess suitable clothing and equipment is worn.
- The client understands they are responsible for any damage or injury caused to themselves, their horse(s), or any third parties present during the shoot.
- The photographer will not be held liable for injury up to and including death.
- The photographer takes care of the photographs. In the unlikely event the photographs are lost, stolen or destroyed beyond the photographer’s control a second shoot will be arranged.
- The photographer must be notified within 7 days of any damages caused to products within time of postage date.
Copyright
- The entire copyright is retained by the photographer throughout the world at all times. The client must seek permission for third party use (Not including friends and family)
- Only images chosen, edited and delivered are granted use by client.
- Commercial use and sale of images is strictly prohibited unless agreed in writing.
- The client allows the photographer to display any photographs to promote the business eg. Website, Social media, competitions, products and product samples.
